1. GENERAL PROVISIONS
1.1. The "Namų Meka" rules for the purchase and sale of goods (hereinafter referred to as the "Rules") are a legally binding document for the parties, which establishes the mutual rights, obligations and responsibilities of the Buyer and the Seller when the Buyer purchases goods. The Seller reserves the right to change, amend or supplement these existing Rules at any time, in case of changes, to inform the Buyers on the website of the online store.
Goods are tangible items offered for purchase by the Buyer through the online store administered by the Seller.
Seller – Selling goods in the online store www.namumeka.lt, personal data controller – MB “Namų Meka”, legal entity code 306628997, registration address: Perkūnkiemio g. 19, LT – 12120, Vilnius, e-mail: info@namumeka.lt, tel. No. +37067477251. The company has appointed a person responsible for personal data protection, whom you can contact using the specified contacts.
Buyer – a natural or legal person who uses the online store and purchases Goods there.
Account – the result of the Buyer's registration in the online store, which creates a personal Buyer section in the online store that stores their personal data, messages and order history.
Personal data – any information collected by the Seller about the Buyer or his representative (natural person) as defined in Article 4(1) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
Parties – Seller and Buyer.
2. MOMENT OF CONCLUSION OF THE PURCHASE-SALE AGREEMENT
2.1. The contract is considered concluded from the moment the Buyer creates a shopping cart in the online store, selects one of the payment methods, indicates the delivery address, and pays for the goods, having previously familiarized himself with these rules and accepting them, confirms his agreement by checking the box "I confirm that I have read and agree to the Purchase Rules and Privacy Policy", and then clicks the button to confirm the order.
3. SELLER'S RIGHTS
3.1. If the Buyer attempts to undermine the stability and security of the online store or violates its obligations, then the Seller has the full right to immediately and without warning limit, suspend or terminate the Buyer's ability to use the online store.
3.2. The Seller undertakes to provide all conditions for the Buyer to properly use the services provided by the online store "Namų Meka" (www.namumeka.lt).
3.3. In the event of important circumstances, the Seller may temporarily or completely terminate the operations of the online store without prior notice to the Buyer.
3.4. The Seller may unilaterally change the terms of these Rules.
3.5. If a system error results in an incorrect price for a product in the online store, the seller has the full right to cancel the buyer's order, having previously informed the buyer by e-mail or by contacting the contact phone number.
4. SELLER'S OBLIGATIONS
4.1. If the Seller is unable to deliver the ordered goods to the Buyer due to important circumstances, he/she undertakes to offer an analogous or as similar product as possible in terms of its characteristics.
4.2. If the Buyer refuses to accept an analogous or similar product, the Seller undertakes to return the money to the bank account from which the payment was made.
4.3. If the Buyer does not provide accurate data in the registration form, the Seller is not responsible for the provision of incorrect data and any inconvenience caused.
4.4. The Seller has the right to extend the delivery period of the goods if this occurs due to circumstances beyond the Seller's control (e.g. the manufacturer does not have the goods in stock, the transport company is late in delivering the goods, etc.). The Buyer shall be immediately informed of this by telephone or e-mail.
4.5. The Seller undertakes to return the money paid to the Buyer within 14 (fourteen) days, after assessing the quality of the goods and meeting the return requirements.
4.6. The money is refunded by making a transfer to the Buyer's account from which the transfer was made, or by indicating another bank account when filling out the refund form.
5. BUYER'S RIGHTS AND OBLIGATIONS
5.1. The buyer has the right to return the goods if: the goods have not been used, their appearance has not changed, the goods have not been damaged, and the original packaging of the goods has not been damaged.
5.2. When ordering goods, the Buyer undertakes to correctly indicate the place of delivery of the goods and other data necessary for the delivery of the goods.
5.3. The Buyer has the right to withdraw from the contract for the purchase and sale of goods concluded with the online store by notifying the Seller in writing (by e-mail, indicating the desired return of the goods and their order number by filling out the form) no later than 14 working days from the date of delivery of the item.
5.4. In the event that the Goods are returned, the Buyer, having submitted a request for the return or replacement of the Goods in accordance with the procedure provided for in these Rules, must immediately, but no later than within 14 days from the date of submission of this request to the Seller, send the returned Goods at his own expense to the Seller at the following address: Tauragės g. 26, Vainutas, LT – 99434, Šilutės district. The Buyer shall bear all direct costs of returning the goods.
5.5. The buyer, wishing to return a quality product, shall cover all transportation costs.
6. ORDERING GOODS, PRICES, PAYMENT PROCEDURE, TERMS.
6.1. Orders are accepted only through the online store "Namų Meka" (www.namumeka.lt).
6.2. Payments can be made using Swedbank, SEB, Luminor, Citadele, Šiaulių bankas electronic banking services, as well as Visa/MasterCard payment cards or direct bank transfer to the specified bank account of the online store. Payments are possible in euros. Payments are processed using the "KLIX" payment platform.
6.3. All prices of goods in the online store are indicated in EUR including VAT, and the discount applied to the price of the Goods is also indicated (if applicable).
6.4. The buyer undertakes to pay for the order within 3 calendar days from the date of order confirmation. However, the parcel will only be prepared after payment for the goods has been received.
6.5. If the buyer fails to make payment within 3 calendar days, the order is canceled.
6.6. The Seller delivers the goods within the territory of the Republic of Lithuania after concluding a contract with a specific parcel delivery company. The goods are delivered within 2-5 business days after their order or within another specified period according to the product specification. The goods are delivered at the Buyer's expense up to 60 EUR, when the amount is more than 60 EUR, the goods are delivered at the Seller's expense.
6.7. The buyer, having selected the delivery service during the order, undertakes to indicate the exact delivery location of the goods.
6.8. During delivery of the shipment, the Buyer or, as the case may be, the Buyer's representative must check the condition of the package together with the representative of the shipping service.
6.9. If damage to the package of the shipment is detected, the Buyer/Buyer's representative must not accept the shipment, filling out a special shipment inspection report, indicating the detected damage.
6.10. Upon acceptance of the shipment by the Buyer/Buyer's representative and signing the delivery confirmation without comments, it is indisputably considered that the goods have been delivered in an undamaged package and comply with the terms of the purchase and sale agreement, and the Buyer has no right to make any complaints/claims.
6.11. Upon delivery of the goods to the address specified by the Buyer, the goods are deemed to have been transferred to the Buyer, regardless of whether the goods are actually received by the Buyer or by his representative (by providing personal data). If the goods are not delivered on the scheduled delivery date, the Buyer shall immediately, no later than the day after the scheduled delivery date, inform the Seller thereof (by e-mail and/or telephone).
6.12. If the Buyer refuses to accept the ordered goods or the delivery of the goods is complicated/impossible due to the Buyer's fault - if the incorrect delivery address is specified, the Buyer must unconditionally compensate the Seller for all losses incurred in connection with the Seller's proper fulfillment of its contractual obligations.
6.13. The Buyer, failing to comply with the provisions of these Rules, the binding nature of which is presumed to be indisputable/without any reservations, must assume the resulting liability, which may be assessed and understood as the Seller's right to refuse to deliver the goods ordered by the Buyer, terminating the contract of purchase and sale of goods and making claims for compensation for losses incurred, stating the Buyer's improper performance of contractual obligations.
7. OTHER CONDITIONS
7.1. These rules are governed by the law of the Republic of Lithuania.
7.2. All disagreements arising from the implementation of these rules shall be resolved through negotiations. If an agreement cannot be reached, then the disagreements shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
7.3. The buyer may submit requests or complaints on the electronic consumer dispute resolution platform http://ec.europa.eu/odr/.
7.4. Consumer disputes are resolved out of court by the State Consumer Rights Protection Service, registered office address: Vilniaus str. 25, LT-01402 Vilnius, www.vvtat.lt.
